CHANGES INTRODUCED BY LAW 1/2025 REGARDING “THE GOLDEN VISA PROGRAMME”
Following the adoption of Organic Law 1/2025, Articles 63 to 67 of Law 14/2013 have been officially repealed, putting an end to the Golden Visa programme which granted residence permits to foreigners making significant investments in Spain, such as the purchase of property with a minimum value of €500,000.
Applications submitted prior to the change will continue to be processed in accordance with the previous rules and existing permits may be renewed in accordance with the initial conditions.
DECISIONS OF THE SUPREME COURT OF 14/07/2025 AND 16/07/2025 REGARDING THE APPLICATION OF TAX REDUCTIONS TO INHERITANCE AND GIFT TAX WITHIN THE FRAMEWORK OF THE ACQUISITION MORTIS CAUSA OF SHARES IN A FAMILY-RUN PROPERTY RENTAL BUSINESS
The Spanish Supreme Court has ruled on these disputes, authorising the application of these tax reductions (which amount to 95% in many regions) provided that there is strict fulfilment of the legal conditions for said application, without assessing their justification in terms of economic rationality but only in terms of the strict fulfilment of these conditions; thus prioritising the purposiveness of the law.
